The Ninth Circuit reversed summary judgment for the University of Washington and directed entry of summary judgment for Professor Reges on his First Amendment retaliation and viewpoint discrimination claims, holding that UW violated his First Amendment rights by investigating and reprimanding him for a mock land acknowledgment in his syllabus. The case was remanded to determine appropriate relief and to reconsider the facial challenge to UW's nondiscrimination policy.
