This case involved a dispute over the scope of an arbitrator's authority in an employment matter. An arbitrator was asked to decide whether an employee had violated specific provisions of a Local Civil Service Agreement (LCA). However, during the arbitration process, the arbitrator went beyond what the parties had agreed to and also considered broader "just cause" standards from a Collective Bargaining Agreement (CBA) when making the decision. The appeals court ruled that the arbitrator had overstepped their boundaries. While the court upheld part of the original arbitration award, it threw out the portions where the arbitrator had considered standards beyond what was originally agreed upon. The court ordered a new judgment that would only confirm the parts of the award that stayed within the arbitrator's proper authority. When union representatives and employers agree to arbitration, they need to be specific about what questions the arbitrator can address. Workers should understand that arbitrators must stick to the agreed-upon scope – they can't expand their review to cover additional employment standards or contract provisions that weren't part of the original arbitration agreement.
