This appeal arises from a dispute over the construction of a swimming pool. The defendant entered into a written contract with the plaintiff for the construction of a pool at the defendant's home. The plaintiff later filed a complaint alleging that the defendant failed to pay the amount due under the contract. The defendant filed a counter-complaint and alleged breach of contract, fraud and/or misrepresentation, and violations of the Tennessee Consumer Protection Act. After a bench trial, the trial court found in favor of the plaintiff. The defendant subsequently filed a motion for relief from the judgment, which the trial court denied. The defendant appeals. We affirm the trial court's decision and remand for determination of appellate attorney's fees.
The magistrate properly denied employer's request for a writ of mandamus. Some evidence supported Industrial Commission's decision that employee was unable to work as a direct result of an impairment arising from his workplace injury and not due to reasons unrelated to the injury.
1. An injured employee's right to assert a direct claim for unpaid medical expenses is not precluded by a medical provider's failure to intervene in a pending workers' compensation proceeding under Minnesota Statutes section 176.361 (2022). 2. The compensation judge's findings that the injured employee sustained a permanent work injury on October 1, 2018, and the compensation judge's apportionment determination, are not manifestly contrary to the evidence. Affirmed in part, reversed in part, and remanded.
